These Terms of Service ("Terms") govern your use of the services provided by Dave's Shoe Repair Incorporated, doing business as Dave's Leather Care ("we," "us," or "our"). By using our services or website, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website, contacting us for services, or bringing items to our facility, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Description of Services

Dave's Leather Care provides professional leather cleaning, repair, restoration, and related services including but not limited to:

  • Leather jacket and coat cleaning
  • Suede cleaning and restoration
  • Leather repair and patching
  • Color restoration and touch-ups
  • Conditioning treatments
  • Hardware replacement and repair
  • Stain removal services

3. Service Agreement and Estimates

Estimates and Pricing

All estimates are provided free of charge and are valid for 30 days. Final pricing may vary based on the actual condition of items and services required. We will contact you for approval before performing any work that exceeds the original estimate by more than 20%.

Service Authorization

By leaving items with us for service, you authorize us to perform the agreed-upon work. You represent that you are the owner of the items or have proper authorization to have them serviced.

4. Payment Terms

  • Payment is due upon completion of services unless other arrangements are made
  • We accept cash, credit cards, debit cards, checks, and electronic payments
  • For orders over $200, a 50% deposit may be required
  • Returned check fees: $35
  • Late payment fees may apply to accounts over 30 days past due

5. Item Storage and Pickup

Storage Policy

Completed items will be held for 90 days at no charge. After 90 days, a storage fee of $5 per week will be applied. Items not claimed within 180 days may be disposed of at our discretion.

Pickup Requirements

Items must be picked up by the person who dropped them off or their authorized representative. Photo identification may be required. Pickup receipts must be presented when available.

6. Limitations and Disclaimers

Service Limitations

While we use professional techniques and quality materials, we cannot provide absolute results for all items. Factors beyond our control include:

  • Age and condition of leather
  • Previous treatments or damage
  • Manufacturing defects
  • Natural variations in leather
  • Inherent characteristics of certain materials

Risk Acknowledgment

You acknowledge that leather cleaning and restoration involves inherent risks, including but not limited to color changes, texture alterations, or structural changes. We will discuss potential risks before beginning work on valuable or delicate items.

7. Liability and Insurance

Limitation of Liability

Our liability for any claim related to our services is limited to the lesser of:

  • The cost of the services performed
  • The fair market value of the item at the time of service
  • $500 per item unless a higher value is declared and additional insurance purchased

Insurance Coverage

We maintain general liability insurance for our operations. For items with declared values over $500, additional insurance coverage is available for an additional fee.

8. Satisfaction Policy

We stand behind our work and strive for customer satisfaction. If you are not satisfied with our services:

  • Contact us within 7 days of pickup
  • We will evaluate the concern and work to resolve it
  • Remedies may include re-service, partial refund, or full refund
  • Our satisfaction policy does not cover normal wear or damage after service

9. Cancellation and Refund Policy

Service Cancellation

You may cancel services before work begins for a full refund. Once work has commenced, cancellation fees may apply based on work completed and materials used.

Refund Processing

Approved refunds will be processed within 7-10 business days using the original payment method when possible.

10. Website Terms

Acceptable Use

You agree to use our website only for lawful purposes and in accordance with these Terms. Prohibited uses include:

  • Attempting to gain unauthorized access to our systems
  • Transmitting harmful or malicious code
  • Interfering with website functionality
  • Collecting user information without consent
  • Using automated systems to access the website

Intellectual Property

All content on our website, including text, images, logos, and design elements, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

Dispute Resolution Process

In the event of a dispute, we encourage direct communication to resolve issues. If direct resolution is not possible, disputes will be resolved through binding arbitration in Jefferson County, Colorado, in accordance with the rules of the American Arbitration Association.

13. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labor disputes, or supply chain disruptions.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
